I had a 401k several years ago with Jitney Jungle who now does not exist. Does the 401k still exist?

I have a form 5500 that has the EIN and an admins number as well. I talked to them. I have spoke with Winn-Dixie personnel all with dead ends. Spoke with a number of investment firms, Dept of Labor, Dept of Treasury, banks all to no avail. I have been searching for information for the last 10-15 years. I worked for the company in the early 90's. I have made calls from AL to MS to FL to NY. Got nothing. I keep feeling like I'm just not getting the right person. Last person I talked to was rude to me. Which doesn't help my nerves. Is there someone that I could actually talk to that would help with my search. Or should I just give up?!

You can actually contact the Social Security Administration and request a SSA-L99-C1. They should have a record of any pension or retirement account attached to your social security number. I am not sure how difficult this is, but if worse comes to worse that is an option.

Also, try searching your state's "unclaimed property" database. We find all kinds of investment related property for clients in our CA portal! Good luck...

Michelle. First, the good news is that your retirement money is protected. So if you had a vested balance it cannot be taken from you.

When a company acquires another company, it is not obligated to take over the company's retirement plan. In many cases, the employees years of service start over and for all practical purposes, are new employees of the acquiring firm.

The first thing I would check would be an old W2 you have from a tax return when you worked for the firm. It will indicate if you contributed any of your money to the plan (which vests immediately vs money your employer contributes which could take time before it vests). You do not automatically have money in a 401k plan just by being employed.

I tried to find Jitney Jungle on the Department of Labor's Abandoned Plan Search but maybe you have better parameters than I did. If the company abandons the plan, the Department of Labor should list it here. http://askebsa.dol.gov/AbandonedPlanSearch/

My gut feeling is that the Department of Labor is your best source to find the plan. Did you call the number from this website? http://www.dol.gov/ebsa/contactEBSA/consumerassistance.html

It will take some investigative work and some time but if you had a vested balance, it should be somewhere.

If you speak with some at the Department of Labor and they use any words your don't know, don't hesitate asking here. I am sure myself or one of the other valuable contributors will help you out.

Winn-Dixie was sold to Bi-Lo (BiLo Holdings, LLC). Perhaps they could help? Sounds like a very frustrating situation.

Yep, did that too. They have no record of anything. I did finally get a return call with a lady today that actually worked for the company in the trust department. She remembers a lot of the details that I do and may even remember where the 401ks went after the merger. She remembers it was in Atlanta, but the name of the firm she is going to have to find. She is helping me with doing research and she now works for a firm that deals with IRAs, 401ks and other retirement plans. May be I have found my person. It's been a long a search.
