My husband passed away in Jan. I get his retirement instead of mine. On the form it stated he had a 403b in 2009.

Would this be for me as at that time I was his fiancée just married in 2011 after being together for 28yrs. Is there a beneficiary. The SS letter has my name before I was married. Could there not be a beneficiary? If there is a beneficiary what happens next

Donna, A 403b plan provides for a beneficiary to be designated. If you were designated as beneficiary you can rollover the balance to your own IRA or leave it in your spouses account as an inherited IRA. There are pros and cons to each which I won't bore you with at the moment as the first thing to find out if there is a beneficiary. You can find out by contacting the plan administrator.

If there is no beneficiary designated, your husbands will determines who receives the assets.

If here is no will state law determines distribution of assets.

If you would like to discuss the specifics of your case in more detail privately, please contact me at cschiffer@aepg.com or via phone at 908-821-9764.
