Can I cash it out ? my 401k from my old job ? I was fired and still have an active 401k?
Hi Joseph, the answer to your question is "it depends". Option that you have are : roll it over to another 401k plan if you are or willing to be employed by another company that has equal or verified and allowed plan to receive other qualified plan proceeds. Secondly, roll it over into an IRA held ...  (more)

401K plan fails ADP test, participant receives distribution?
Brian, I agree with Guy. You are stating Penalty and loss. This two words are totally different and construed to be ambiguous in format. If you don't remember there is a good chance you may not have one established. Hi James, Under no circumstances 401k plans should limit participants for elective deferrals. Such plan should abide by ERISA (404c) and shall not assign limitations. If what you say is true then such plan should be looked for misguidance from TPA record keeper and plan formation clauses. Limitatio...  (more)

I agree with above messages. That kind of amount should be converted into a ROTH IRA if is not going to be a tax burden for you. good question Daniel! There is a lot of criteria to consider before making a recommendation. However, there is no right and wrong answer here.
